Environmental Groups Urge California to Enforce Stricter Emissions Rules

Last week, more than eight environmentalists and organizations wrote a letter to California Governor Gavin Newsom asking him to enforce stricter emission regulations. According to Scott Hochberg whose organization Center for Biological Diversity’s Climate Law Institute co-signed the letter, Californians deserve an electric future as the residents deal with the highest gas prices in the nation with gasoline costing $5 per gallon.

The environmental groups and organizations want the governor and the state air regulators to support efforts that will increase electric vehicles (“EVs”) and set higher annual emissions reductions for internal combustion engine (“ICE”) vehicles. They want 7% annual increases in emissions reductions in comparison to the 5% average that was adopted during the Obama administration.

As more states look into adopting climate-friendly mandates, the state’s electrification timeline is moving at a faster rate in comparison to President Joseph Biden’s. In 2020, the governor announced that the state would drastically change its demand for fossil fuel by phasing out gasoline-powered cars by 2035.

In a proposal released last year, the California Air Resources Board (“CARB”) aimed for 68% zero emission vehicles for new vehicles in 2030, 76% in the following year and 100% in 2035. The group behind the recent letter has termed this initiative as insufficient.

California is the biggest state market for electric cars, accounting for nearly one-tenth of all U.S. EV sales last year. It also became the first state in the country to sell more than a million electric vehicles. According to the group, the state aims to reach more than 60% zero-emission electric vehicles sales by 2030. This is in comparison to the Biden administration goal of having new electric vehicles sold account for 50% .

Newsom didn’t make any comment on the letter that was signed by environmentalists including Greenpeace USA, Friends of the Earth and the California Democratic Party Environmental Caucus.

California was among 22 states that urged the U.S. Court of Appeals for the District of Columbia to defend new mandates from the Environmental Protection Agency. The mandates set in December would require a 28.3% reduction of vehicle emissions until 2026.

Moreover, the agency is looking to restore California’s legal authority to set tougher vehicle emission rules and zero-emission vehicle mandates. The EPA gave the state permission to set the vehicle rules in 2013, but the waiver was revoked in 2019 during the Trump era. According to Nick Conger, the agency’s spokesman, the EPA is set to finalize the decision in the near future.

As stricter emissions regulations are enforced, demand for the electric vehicles made by companies such as Fisker Inc. (NYSE: FSR) will rise and the transition to EVs could happen faster than initially anticipated.
